Any order implies the Customer's full and unreserved acceptance of these Terms. The applicable Terms are those in force on the date the order is confirmed.

Premium offer. A lifetime Premium licence unlocking all of the paid features described on the site (all spots including the secret beaches, generated day plan, weather and marine risk notifications, GPS routes, filters and the full interactive map, hour-by-hour weather). This is a personal-use licence of indefinite duration, with no subscription or renewal.
The Customer places an order via the site: selection of the Premium offer, entry of the necessary information (in particular the email address), express acceptance of these Terms, payment, then confirmation by email. Confirmation of the order constitutes conclusion of the contract. The Publisher reserves the right to refuse or cancel any order in the event of a prior dispute, a payment incident or a suspicion of fraud.
Payment is made online, in cash and in full, upon confirmation of the order. Transactions are secured by our payment provider Stripe (bank card and the means of payment offered on the site). The Publisher neither has knowledge of nor retains any of the Customer's bank details. The order is only definitively recorded once payment has been accepted; in the event of rejection, the order is automatically cancelled and the Customer is informed by email.
The Premium offer is digital content supplied on an intangible medium. Its activation is immediate after confirmation of payment, and a confirmation email (with a link or access key where applicable) is sent to the address provided by the Customer. The Customer is solely responsible for the accuracy of this address. In the event of non-receipt within 24 hours (including in the spam folder), the Customer is invited to contact map.moris.insider@gmail.com.
Pursuant to article L.221-18 of the French Consumer Code and to Directive 2011/83/EU, the consumer is in principle entitled to a period of fourteen (14) days in which to withdraw. However, in accordance with article L.221-28, 13° of the same Code, this right does not apply to the supply of digital content not provided on a tangible medium where performance has begun after the consumer's express prior agreement and express waiver of their right of withdrawal.
By confirming their order and ticking the box provided for that purpose, the Customer expressly requests immediate access to the Premium content and expressly waives their right of withdrawal. Consequently, no refund may be claimed once access has been delivered, except in the event of a proven failure of performance attributable to the Publisher. If, despite payment, access has not been delivered within 48 hours and customer service has been unable to remedy the situation, the Customer may request a full refund by email; this will be made within fourteen (14) days using the same means of payment.
Premium access is strictly personal. The Customer undertakes not to communicate, resell or make it available to any third party. Any fraudulent use, any mass sharing or any attempt to circumvent the technical protections entitles the Publisher to suspend access, without refund and without prejudice to any legal action.
The Publisher undertakes to provide a service in accordance with the descriptions displayed, within the framework of an obligation of means. The Customer benefits from the applicable statutory warranties. The Publisher cannot be held liable for: information relating to the third-party establishments mentioned (opening hours, closures, prices, quality of welcome); weather and marine forecasts, which come from third-party sources and are provided strictly for guidance only; damage related to travel to the spots or to the practice of water-based or outdoor activities in reliance on the information provided; service interruptions arising from a case of force majeure or a failure of a third party (host, payment operator, weather data provider).
Safety. The Customer acknowledges that the spots may be located in natural or remote areas and may present risks. They undertake to comply with local safety instructions, to check conditions with the official bodies before any entry into the water, and to take out appropriate insurance. In any event, the Publisher's total liability is limited to the amount actually paid by the Customer for the Premium offer.
All elements of the site and the application (texts, descriptions, photographs, maps, editorial selections, the "Moris Insider" brand, logo, graphic identity, spots database, source code) are protected by the applicable legislation. Purchase of the Premium offer grants the Customer a strictly personal, non-exclusive, non-transferable and non-commercial right of use. Any reproduction, distribution or commercial exploitation without prior written authorisation is prohibited. The underlying map base (Google Maps / My Maps) remains the property of its rights holders.
The processing of the Customer's personal data is described in our Privacy policy. The Publisher undertakes to comply with the GDPR (EU 2016/679) as well as the Mauritian Data Protection Act 2017. No bank details are retained by the Publisher.
The Publisher cannot be held liable for any failure resulting from a case of force majeure, in particular: natural disasters, cyclones, epidemics, interruption of telecommunications networks, failure of an access provider, a payment provider or a weather data provider, decisions of the public authorities.
These Terms are governed by Mauritian law. For consumers residing in the European Union, the mandatory provisions applicable in their country of residence remain applicable. In the event of a dispute, the Customer is invited to contact map.moris.insider@gmail.com as a first step in order to seek an amicable solution (response within fourteen days). Failing an amicable agreement, consumers residing in the EU may contact, free of charge, a consumer mediation body or the competent consumer protection authority in their country of residence. Failing amicable resolution, and subject to the mandatory consumer-protective provisions, any dispute falls under the jurisdiction of the courts of Port-Louis, Republic of Mauritius.
If any of the provisions of these Terms is declared null and void, the others shall retain their full effect. These Terms are drafted in French; in the event of translation, only the French version shall prevail. The Publisher's computerised records shall be deemed proof of the communications, orders and payments made between the parties.
